Government delays HFSS promotional restrictions to October 2025

The promotional restrictions on HFSS (high fat, salt, sugar) products that were due to come into force in October this year are set to be delayed until October 2025.

The government said it continues to review the impact of the restrictions on shoppers and businesses, particularly in the backdrop of the cost of living crisis.


“I firmly believe in people’s right to choose – and at a time when household budgets are under continuing pressure from the global rise in food prices, it is not fair for government to restrict the options available to consumers on their weekly shop,” Prime Minister Rishi Sunak said.

The restrictions on volume promotions in England will affect any convenience store business with more than 50 employees. Promotions affected include:

  • A multibuy promotion where you offer a financial incentive for buying multiple items (for example ‘3 for £10’)
  • A promotion where you offer a product or any part of a product free (for example ‘buy one get one free’)
  • The promotion of HFSS products alongside non-food products (for example ‘buy a soft drink and get a newspaper free’)

The Association of Convenience Stores (ACS) has welcomed the development.

“This delay to banning volume promotions on a broad range of products will be welcomed by consumers who are facing enough challenges with inflation without legislation like this further increasing shopping bills,” James Lowman, ACS chief executive, said.

“It is also welcome relief for our members, already struggling with high energy prices, rising interest rates and increasing product costs from suppliers. Far more stores are subject to these regulations than the location restrictions on these products, which were introduced last year and which only apply to stores over 2,000 square feet.”

The restriction of HFSS products by location came into force in October last year.

The regulations affect England only, with Wales and Scotland currently consulting on how to move forward with their own HFSS regulations.

“The additional time provides an opportunity for Wales and Scotland, who are both considering separate approaches to HFSS regulations, to align their regulations with those coming into force in England to avoid confusion and unnecessary problems for customers, retailers and suppliers,” Lowman said.

“We will continue to argue that any regulations need to be proportionate and effective measures, backed by evidence that they will actually tackle obesity.”

High Street Rental Auctions: Independent retailers urged to engage with local councils

The British Independent Retailers Association (Bira) has urged independent shop owners to reach out to their local councils about the government's newly announced High Street Rental Auction (HSRA) powers, which aim to tackle persistently vacant commercial properties on UK high streets.

Introduced through the Levelling Up and Regeneration Act 2023, the HSRA legislation will come into force on 2 December. It will give local authorities the ability to put the leases of long-term empty shops up for public auction, allowing businesses and community groups to secure short-term tenancies.

Inflation jumps in October on higher energy bills

Britain's annual inflation rate jumped more than expected in October to back above the Bank of England's target as households and businesses faced higher energy bills, official data showed Wednesday.

The Consumer Prices Index reached 2.3 per cent from a three-year low of 1.7 percent in the 12 months to September, the Office for National Statistics said in a statement.

Nestle to step up marketing investment; Waters and beverages to become standalone business

Nestle on Tuesday said it will increase investment in advertising and marketing to 9 per cent of sales by the end of 2025. The company also announced plans to make its waters and premium beverages activities a global standalone business from New Year.
